Understanding and applying equity principles is not a game. People can get into trouble if they don’t know what they are doing. However, once you grasp the concepts, it can become quite engaging and even enjoyable: Equity and Financial Freedom

Knowledge and Preparation: Within equity, knowledge and preparation are essential. You may be required to attend court, which is normal and should not be intimidating once you understand the processes and your reasons for being there. While there is no guaranteed remedy or certain path, due process of the law and legislation must be followed by those making claims, as well as by the court’s duties and obligations.

Guide Overview: This guide aims to assist you in navigating the complexities of equity. By knowing some specifics and having a clear understanding of what must be done and how to correctly challenge a claimant, you can stand confidently as the beneficiary you are.

Equity and the Law: Understanding Your Rights

Equity follows the law. This law is the settled law of the land, also known as common law. As equity follows common law, it is secondary to it and comes into play if there is any discrepancy. Equity can be heard in all courts since the Judicature Act.

Section 25 of the Judicature Act: This section addresses potential conflicts between common law and equity. It states that if there is any conflict between these principles, equity will prevail.

Since there is a trust in play (as depicted in our “Three Trust Certainties” diagram), there are two objects and two sets of rules. Essentially, a beneficiary receives the benefits, and a trustee is legally responsible.

Using specific legislation correctly allows us to demonstrate that a claimant has no right to a claim (chose) because they operate on the legal side of the trust, while the beneficiary sits on the equitable side.

Key Points:

  • A claim cannot be brought against a beneficiary by a trustee or its agent.
  • Without a chose, there is no claim. Trustees and agents cannot claim against a beneficiary.
  • Any attempt to claim is a breach of trust, entitling the beneficiary to restitution.

By asking pertinent questions through a correctly formatted Data Subject Access Request (DSAR), which an agent is legally obliged to respond to under specific legislation, we can prove that the agent (acting for the trustee) has no chose.

Agents are everywhere: debt collection agents, billing agents, and HMCTS as an agent to the Ministry of Justice. When you start to see it, you see it for what it is—an illusion.

How to: Equity and Financial Freedom

With the correct information, you can start understanding equity and trust law. Learn how to use the equitable side of the trust and not be held to the legal/responsible side.

Key Concepts:

  • Specific Legislation: Understand and use the specific legislation relevant to equity and trust law.
  • Financial System Reality: Realise there is no “money” used in our financial system as traditionally understood.
  • Beneficiary Role: Embrace your role as the beneficiary and conduct yourself accordingly. It is not difficult once you start correctly.

Operating as a Beneficiary: Find out what it means to use the title of the beneficiary and operate in the jurisdiction of equity, as opposed to at law, where the game is rigged in favour of the legal society. Learning these fundamentals can save you time, frustration, and cost. Even if you already have a good understanding, there will be lightbulb moments. For those new to equity, this will set you on the right path to financial freedom.

Current Financial Challenges: There are huge price hikes as all the additional cash and quantitative easing pumped into the economy during the lockdown are absorbed by the goods we buy, causing inflation. The goods act as sponges absorbing the cash and driving prices up. Part of the agenda is debt slavery. Once you understand, you shall become financially free.
