What is equity?

This is not a game, people get into trouble because they don’t know what they are doing, but when you do, it becomes quite fun and that is what it should be..

Knowledge and preparation are key within equity, you may be required to attend court, this is normal and should not be intimidating once you know what you are doing and why you are doing it.

There is no certain path or guaranteed remedy, but there is due process of the law and legislation that must be followed by those parties making claims as well as the duties and obligations of the court.

This is a guide to assist you, knowing some specifics and with a clear understanding of what must be done and how to correctly challenge a claimant you shall be in a position standing as the beneficiary you are.

Equity follows the law. This law is settled law of the land, common law.

As equity follows this it is secondary to it and comes into play if there is any discrepancy.  Equity can be heard in all courts since the Judicature Act.

Section 25 of the Judicature Act: It was foreseen that a court which applied the rules both of common law and of equity would face a conflict where the common law rules would produce one result, and equity another. Section 25 of the Judicature Act 1873 provided that if there was any conflict between these principles, then equity was to prevail.

Since there is a trust in play [of titles Three trust certainties diagram] there are two objects and two sets of rules, in essence; a beneficiary receives the benefits and a trustee is legally responsible.

Using specific legislation correctly allows us to evidence that a claimant has no right to a claim (chose) because they are on the at law side of the trust, the legal side as opposed to equitable side where the beneficiary sits.

It stands to reason that a claim cannot be brought against a beneficiary by a trustee or its agent.

Without a chose there is no claim. Trustees and Agents cannot have a claim against a beneficiary.
Any attempt to claim is a breach of trust and restitution due to the beneficiary(s); us.

By asking pertinent questions pursuant to specific legislation, we can evidence that an agent (acting for trustee) has no chose.

Agents are everywhere, debt collection agents, billing agents, HMCTS is agent to the Ministry of Justice…when you start to see it, you see it for what it is: an illusion.

With the correct information start understanding equity and trust law; learn how to use the equitable side of the trust, and not be held to the legal/responsible side.

Using specific legislation and realising there is no “money” used in our financial system.

That we are the beneficiary – we conduct ourselves accordingly, it is not that difficult once started correctly.

  • Find out what it means to use the title of the beneficiary and operate in the jurisdiction of equity, as opposed to at law, where the game is rigged in favour of the legal society.
  • Learn the fundamentals and much more; save yourself time, frustration and cost.
  • Even with a good understanding already, there will be lightbulb moments, and with no idea about equity this will set you up on the right path from the outset to financial freedom.
